lens won't retract and camera won't turn off.

I just bought this camera for my daughter, picked it up today, turned it on, got notheing but a previously taken pic on the screen. the camera willnot turn off unless you remove the batteries and the lens stays out. Any suggestions. i think i will just return to retailer....
